Terms and Conditions and Release of Liability

The University of Southern California (“University”) is not the tour operator of any Trojan Travel tours. By signing up for a Trojan Travel tour, travelers are contracting with a third-party tour operator, and not the University.

The University shall not be responsible for breach of contract, failure to comply with any state or federal laws, including the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such third-party tour operator or its suppliers.

For avoidance of doubt, the University is not responsible for changes of flight times, fare changes, damage, loss of baggage, dishonor of airline, hotel or other reservations, delays, losses, injuries, inconveniences, cessation of operations, airline or tour company bankruptcies, accidents, or for the acts or omissions of any person or entity engaged in providing services to the travelers, including conveying travelers, or in carrying out other arrangements of the tour. Without limiting the foregoing, if due to weather, flight schedules or other uncontrollable factors traveler is required to spend additional nights, the University will not be responsible for traveler’s hotel, transfers, meal costs or other expenses.

The tour operator reserves the right to decline to accept or to retain any person as a member of the tour should such person’s health, actions or general deportment impede the operation of the tour or the right or welfare of other travelers. No refund will be made available for the unused portion of any tour.

The University shall not be responsible for, and traveler, on traveler’s behalf on the behalf of traveler’s heirs and assigns, hereby releases the University from, any claims, injuries, damages or other losses from any cause whatsoever, including but not limited to those in connection with the tour and its operation, terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climate conditions, abnormal conditions or developments, or any other actions, omissions, or conditions occurring during or relating directly or indirectly to a Trojan Travel tour, the reservation, preparation or carrying out thereof. Traveler brings baggage and all personal property on the tour completely at the traveler’s own risk. Traveler further assumes complete and full responsibility for, and hereby releases the University from, any duty to check or verify any and all passport, visa, vaccination, or other requirements of each destination, and all safety and security conditions of such destinations. Notwithstanding the foregoing, it is recommended that U.S. citizens traveling to Canada, Mexico, or the Caribbean, do so with a valid U.S. Passport. By embarking upon a Trojan Travel tour, the traveler voluntarily assumes all risk involved in such travel—whether expected or unexpected. Traveler is hereby warned of the risks listed above as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of a personal emergency. Traveler is advised to obtain appropriate insurance coverage against these risks. Traveler’s completion of a tour reservation, submission of a Trojan Travel information form, or retention of tickets, reservations, or bookings after issuance shall constitute an acknowledgement and consent to these terms and conditions and release of liability.
